You must check your account regularly and respond promptly to messages from Writers, support staff, or the Company. Failure to respond to requests for clarification or additional materials may delay delivery and does not entitle you to deadline extensions or refunds.

- Harassing, threatening, or abusing Writers, staff, or other Users
- Reselling, redistributing, or commercially exploiting our Services or Products
- Requesting content that is illegal, defamatory, obscene, or promotes discrimination
- Attempting to reverse engineer, decompile, or extract source code from our platform
- Using our Services to compete with us or develop competing services
- Circumventing payment obligations through chargebacks, payment reversals, or fraud
- Creating multiple accounts to abuse promotions, bonuses, or refund policies
Consequences of Prohibited Use
Violation of these prohibitions may result in immediate termination of your account, cancellation of all Orders without refund, legal action, and reporting to appropriate authorities. We reserve the right to pursue all available legal remedies for prohibited use of our Services.
Additionally, we may share information about violations with educational institutions, payment processors, law enforcement, or other relevant parties as necessary to protect our rights, safety, property, or that of others.
7. Ordering Process

7.3 Writer Assignment
After Order confirmation, we will assign a qualified Writer to your Order based on subject expertise, availability, and performance history. Assignment typically occurs within 30 minutes to 2 hours, depending on Order complexity and deadline urgency.
If we cannot find a suitable Writer for your Order, we will notify you immediately and issue a full refund. You may request a specific Writer if they are available, though we cannot guarantee Writer selection.
7.4 Order Modifications
Before a Writer begins work, you may modify Order instructions at no additional charge. Once work has commenced, modifications may require:
- Additional payment if the changes significantly increase scope or complexity
- Deadline extension if changes cannot be accommodated within the original timeframe
- Writer approval if changes substantially alter the nature of the assignment
Significant modifications after work has begun may be treated as a new Order requiring new payment.

8. Payment Terms

8.6 Chargebacks and Payment Disputes
If you dispute a charge with your payment provider (chargeback) without first attempting to resolve the issue with us directly, you agree that:
- Your account will be immediately suspended pending investigation
- We may pursue legal action to recover funds and associated costs
- You forfeit rights to any Products, revisions, or refunds
- You may be liable for legal fees and collection costs

9. Delivery Policy
9.1 Delivery Timeline
Products will be delivered by the Deadline specified in your Order. Delivery occurs when the Product is uploaded to your account dashboard and you receive email notification.
We make every effort to deliver on time, but Deadlines are estimates, not guarantees, except where explicitly stated. Factors beyond our control (technical issues, natural disasters, Writer illness) may affect delivery. We will communicate any delays immediately.
9.2 Delivery Method
Products are delivered electronically through your account dashboard in the file format specified in your Order (typically .doc, .docx, or .pdf). You are responsible for downloading and saving Products. We retain Products for 30 days after delivery, after which they may be deleted from our servers.
9.3 Progressive Delivery
For large Orders (typically 20+ pages), you may opt for progressive delivery where the Product is delivered in installments (e.g., chapter by chapter). Each installment must be approved before the next begins. Progressive delivery extends the overall timeline and may incur additional fees.
9.4 Acceptance of Delivery
Upon delivery, you must review the Product and either:
- Approve the Order: Confirming satisfaction with the Product
- Request Revisions: Identifying specific issues to be corrected
- Open a Dispute: Raising concerns about quality or instruction violations
If you take no action within 14 days of delivery (30 days for orders over 20 pages), the Order is automatically approved and funds are released to the Writer. After approval, refund options are severely limited.
9.5 Deadline Extensions
In certain circumstances, we may request a Deadline extension:
- Awaiting additional materials or clarifications from you
- Technical difficulties or system outages
- Order complexity exceeding original scope
- Writer emergency or unforeseen circumstances
Extension requests require your written approval. If you decline an extension and we still miss the original Deadline, you qualify for a full refund according to our Money-Back Guarantee.
10. Revision Policy

We offer unlimited free revisions within 14 days of delivery (30 days for orders over 20 pages) to bring the Product into compliance with your original Order instructions. Revision requests must:

Revisions are typically completed within 24-48 hours depending on the extent of changes required. Urgent revision requests may incur additional fees. The revision period does not extend your deadline for Order approval or dispute filing.
10.4 Revision Limits
While we offer unlimited revisions, this right can be forfeited through abuse. If you submit excessive revision requests (typically more than 5 rounds) without clear justification or if requests repeatedly introduce new requirements, we reserve the right to close the Order and deny further revisions. In such cases, dispute resolution processes remain available.
11. Refund Policy

You represent and warrant that you own or have necessary rights to all content you provide, and that such content does not violate any third-party rights or laws.
12.4 Infringement Claims
If you believe that any content on our platform infringes your intellectual property rights, please contact us immediately at legal@smartacademicwriting.com with detailed information about the alleged infringement. We will investigate and take appropriate action in accordance with applicable law.
13. Confidentiality and Privacy

We treat all User information and Order details as strictly confidential. We will not disclose your identity, Order information, or any communications to third parties except:
- When required by law or legal process
- To Writers assigned to your Order (on a need-to-know basis)
- With your explicit consent
- To protect our rights, property, or safety

13.2 Data Protection
Our data collection, storage, and usage practices are governed by our Privacy Policy, which is incorporated into these Terms by reference. We employ industry-standard security measures to protect your data, including encryption, secure servers, and access controls. However, no method of transmission over the Internet is 100% secure, and we cannot guarantee absolute security.
13.3 Product Confidentiality
All Products created for you are confidential and will not be resold, reused, or shared with other Users. Each Product is custom-written specifically for your Order. We retain Products in our database for quality assurance and dispute resolution purposes but do not make them publicly available or resell them.
14. Warranties and Disclaimers

Our total liability to you for any claims arising from or related to these Terms or our Services shall not exceed the amount you paid for the specific Order giving rise to the claim, or $500, whichever is less.
This limitation applies regardless of the legal theory upon which the claim is based, whether in contract, tort, negligence, strict liability, or otherwise, even if we have been advised of the possibility of such damages.
15.2 No Liability for User Actions
We are not liable for any consequences resulting from your use or misuse of Products, including but not limited to violations of academic integrity policies, plagiarism accusations, grade penalties, or disciplinary actions by educational institutions. You assume all risks associated with how you use our Services and Products.
15.3 Force Majeure
We shall not be liable for any failure or delay in performing our obligations due to causes beyond our reasonable control, including but not limited to natural disasters, war, terrorism, riots, strikes, government actions, internet outages, power failures, or any other force majeure events.
16. Indemnification
You agree to indemnify, defend, and hold harmless Smart Academic Writing, its officers, directors, employees, agents, licensors, and suppliers from and against all claims, losses, expenses, damages, and costs, including reasonable attorneys’ fees, resulting from:
- Your violation of these Terms or any applicable law
- Your violation of any third-party rights, including intellectual property rights
- Your misuse of our Services or Products
- Any academic misconduct or dishonesty involving our Products
- Any content or materials you provide to us
- Your negligence or willful misconduct
- Any claims by your educational institution arising from your use of our Services
This indemnification obligation survives termination of these Terms and your use of our Services. We reserve the right to assume exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with our defense of such claims.
17. Account Termination
17.1 Termination by User
You may terminate your account at any time by contacting our support team. Upon termination, you will lose access to your account and all associated data. Any active Orders will be processed according to existing agreements, and termination does not relieve you of payment obligations for completed or in-progress Orders.
17.2 Termination by Company
We reserve the right to suspend or terminate your account immediately, without notice or liability, for any reason, including but not limited to:
- Breach of these Terms
- Fraudulent, abusive, or illegal activity
- Multiple chargeback requests
- Harassment of staff or Writers
- Abuse of refund or revision policies
- Creating multiple accounts to exploit promotions
- Providing false information
- Non-payment or payment disputes
17.3 Effects of Termination
Upon termination of your account:
- Your right to access and use Services immediately ceases
- All active Orders may be cancelled without refund
- Bonus credits and promotional balances are forfeited
- Previously delivered Products remain subject to the intellectual property provisions
- Payment obligations for completed Orders remain enforceable
- Confidentiality obligations continue indefinitely
Sections of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, disclaimers, limitations of liability, and indemnification obligations.
18. Dispute Resolution
18.1 Informal Resolution
Before initiating any formal dispute resolution process, you agree to contact us at support@smartacademicwriting.com to attempt to resolve the dispute informally. We will work in good faith to reach a mutually satisfactory resolution within 30 days.
18.2 Binding Arbitration
If informal resolution fails, any dispute arising from or relating to these Terms or our Services shall be resolved through binding arbitration rather than in court, except that you may assert claims in small claims court if your claims qualify.
Arbitration will be conducted by a neutral arbitrator in accordance with the American Arbitration Association (AAA) Commercial Arbitration Rules. The arbitrator’s decision will be final and binding, and judgment on the award may be entered in any court having jurisdiction.
WAIVER OF CLASS ACTIONS
YOU AND SMART ACADEMIC WRITING AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. The arbitrator may not consolidate multiple parties’ claims and may not preside over any form of representative or class proceeding.
18.3 Arbitration Costs
Each party shall bear their own attorneys’ fees and costs unless the arbitrator awards fees and costs to the prevailing party. We will pay all AAA filing, administration, and arbitrator fees for claims less than $10,000 unless the arbitrator determines your claim was frivolous.
18.4 Opt-Out Right
You may opt out of the arbitration agreement by sending written notice to legal@smartacademicwriting.com within 30 days of first accepting these Terms. Your notice must include your name, address, and a clear statement that you wish to opt out of the arbitration agreement. If you opt out, all other terms of this Agreement still apply.
19. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.
To the extent that arbitration does not apply, you agree that any legal action or proceeding arising out of or related to these Terms or our Services shall be brought exclusively in the federal or state courts located in Delaware, and you consent to the personal jurisdiction of such courts.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
20. Modifications to Terms
We reserve the right to modify, update, or replace any part of these Terms at any time at our sole discretion. We will provide notice of material changes by:
- Posting the updated Terms on our website
- Updating the “Last Modified” date at the top of this page
- Sending email notification to your registered email address for significant changes
- Displaying a prominent notice on our website
Your continued use of our Services after any such modifications constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must discontinue use of our Services.
