Terms of Service

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must:

• Create a secure password and keep it confidential
• Notify us immediately of any unauthorized access or security breach
• Not share your account with others or allow others to access your account
• Not use another User’s account without permission
• Log out from your account at the end of each session

You accept full responsibility for all Orders placed through your account, whether authorized by you or not.

You must provide accurate, current, and complete information when:

• Creating your User Account
• Placing Orders and providing Order instructions
• Communicating with Writers or support staff
• Providing payment information
• Submitting revision requests or disputes

Providing false, misleading, or incomplete information may result in account termination and forfeiture of Services without refund.

When placing an Order, you must:

• Provide clear, detailed, and complete instructions
• Upload all necessary materials, sources, and guidelines
• Specify formatting requirements, citation style, and academic level
• Select an appropriate and realistic Deadline
• Respond promptly to any clarification requests from Writers

Failure to provide adequate instructions may result in Products that do not meet your expectations. Incomplete instructions do not constitute grounds for refunds.

You must check your account regularly and respond promptly to messages from Writers, support staff, or the Company. Failure to respond to requests for clarification or additional materials may delay delivery and does not entitle you to deadline extensions or refunds.

You agree to use Products ethically and legally, including:

• Using Products as reference materials and study aids
• Properly citing any portions used in your own work
• Complying with your institution’s academic integrity policies
• Not submitting Products as your own original work
• Not reselling, distributing, or sharing Products with others

Order prices are calculated based on several factors including:

• Academic level (High School, Undergraduate, Master’s, Doctoral)
• Number of pages or words
• Deadline urgency (shorter deadlines cost more)
• Complexity and subject matter
• Optional add-ons (plagiarism report, VIP support, progressive delivery)

All prices are displayed in USD unless otherwise specified. Prices are subject to change without notice, but you will be charged the price displayed at the time you place your Order.

We accept the following payment methods:

• Credit and debit cards (Visa, MasterCard, American Express, Discover)
• PayPal
• Bank transfers (for orders over $500)
• Cryptocurrency (Bitcoin, Ethereum)

All payments are processed through secure, PCI-compliant payment gateways. We do not store complete credit card information on our servers.

Payment is required in full before Writers begin work on your Order. By submitting payment, you:

• Authorize us to charge the specified amount to your payment method
• Confirm that you are authorized to use the payment method
• Accept responsibility for all charges, including applicable taxes and fees
• Agree that funds will be held until Order completion or dispute resolution

Prices do not include applicable taxes (VAT, GST, sales tax) or payment processing fees, which may be added at checkout based on your location and payment method. You are responsible for all taxes and fees associated with your purchase.

We may offer promotional codes, discounts, or bonus credits from time to time. These promotions:

• Are subject to specific terms and conditions stated at the time of offer
• Cannot be combined unless explicitly stated
• May have expiration dates or usage limitations
• Can be modified or terminated at our sole discretion
• Are non-transferable and have no cash value

Abuse of promotional offers may result in account termination and forfeiture of credits without refund.

Products will be delivered by the Deadline specified in your Order. Delivery occurs when the Product is uploaded to your account dashboard and you receive email notification.

We make every effort to deliver on time, but Deadlines are estimates, not guarantees, except where explicitly stated. Factors beyond our control (technical issues, natural disasters, Writer illness) may affect delivery. We will communicate any delays immediately.

Products are delivered electronically through your account dashboard in the file format specified in your Order (typically .doc, .docx, or .pdf). You are responsible for downloading and saving Products. We retain Products for 30 days after delivery, after which they may be deleted from our servers.

For large Orders (typically 20+ pages), you may opt for progressive delivery where the Product is delivered in installments (e.g., chapter by chapter). Each installment must be approved before the next begins. Progressive delivery extends the overall timeline and may incur additional fees.

Upon delivery, you must review the Product and either:

• Approve the Order: Confirming satisfaction with the Product
• Request Revisions: Identifying specific issues to be corrected
• Open a Dispute: Raising concerns about quality or instruction violations

If you take no action within 14 days of delivery (30 days for orders over 20 pages), the Order is automatically approved and funds are released to the Writer. After approval, refund options are severely limited.

We offer unlimited free revisions within 14 days of delivery (30 days for orders over 20 pages) to bring the Product into compliance with your original Order instructions. Revision requests must:

• Be submitted within the revision timeframe
• Identify specific sections requiring correction
• Reference your original Order instructions
• Not introduce new requirements or instructions
• Not request complete rewriting of substantial portions

The following revision requests require additional payment:

• Requests submitted after the free revision period expires
• Changes to original Order instructions or requirements
• Additional pages, sources, or scope expansion
• Change to a different citation format or style
• Substantial rewriting (more than 30% of content)

Revisions are typically completed within 24-48 hours depending on the extent of changes required. Urgent revision requests may incur additional fees. The revision period does not extend your deadline for Order approval or dispute filing.

You qualify for a full refund if:

• You cancel before Writer assignment
• We cannot find a suitable Writer for your Order
• We miss your Deadline without an approved extension
• Verified plagiarism exceeding 30% from a single source
• Duplicate payment due to system error

You may qualify for a partial refund if:

• You cancel after Writer assignment but before delivery
• Quality issues exist but portions of the Product are usable
• Minor plagiarism (15-29% similarity) is verified
• Significant formatting errors that require substantial correction

Refunds are not provided in the following circumstances:

• Grade dissatisfaction (grading is subjective)
• Order already approved by you in the system
• Change of mind after Product delivery and review
• New requirements introduced after delivery
• Taxes, VAT, or payment processing fees
• Orders paid with bonus balance or promotional credits

Upon full payment and Order approval, you receive a non-exclusive, non-transferable license to use the Product for personal, non-commercial, educational purposes. This license includes the right to:

• Use the Product as a reference or study material
• Cite portions in your own work with proper attribution
• Analyze the structure, arguments, and methodology
• Keep the Product for personal records

However, you do NOT have the right to:

• Resell, redistribute, or share the Product with others
• Submit the Product as your own work without substantial modification
• Publish or commercialize the Product
• Remove copyright notices or attribution

All content on our website, including text, graphics, logos, images, software, and design elements, is the property of Smart Academic Writing or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, transmit, display, reproduce, or create derivative works from our website content without express written permission.

By uploading materials, instructions, or other content to our platform, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process this content solely for the purpose of fulfilling your Order. We will not use your content for any other purpose without your consent.

You represent and warrant that you own or have necessary rights to all content you provide, and that such content does not violate any third-party rights or laws.

We treat all User information and Order details as strictly confidential. We will not disclose your identity, Order information, or any communications to third parties except:

• When required by law or legal process
• To Writers assigned to your Order (on a need-to-know basis)
• With your explicit consent
• To protect our rights, property, or safety
• To payment processors for transaction processing

Our data collection, storage, and usage practices are governed by our Privacy Policy, which is incorporated into these Terms by reference. We employ industry-standard security measures to protect your data, including encryption, secure servers, and access controls. However, no method of transmission over the Internet is 100% secure, and we cannot guarantee absolute security.

We warrant that:

• Products will be custom-written according to your instructions
• Products will be original and free from plagiarism
• Products will meet general academic standards for the specified level
• We will make reasonable efforts to deliver by the Deadline
• We will provide free revisions as outlined in our Revision Policy

Our total liability to you for any claims arising from or related to these Terms or our Services shall not exceed the amount you paid for the specific Order giving rise to the claim, or $500, whichever is less.

This limitation applies regardless of the legal theory upon which the claim is based, whether in contract, tort, negligence, strict liability, or otherwise, even if we have been advised of the possibility of such damages.

We are not liable for any consequences resulting from your use or misuse of Products, including but not limited to violations of academic integrity policies, plagiarism accusations, grade penalties, or disciplinary actions by educational institutions. You assume all risks associated with how you use our Services and Products.

You agree to indemnify, defend, and hold harmless Smart Academic Writing, its officers, directors, employees, agents, licensors, and suppliers from and against all claims, losses, expenses, damages, and costs, including reasonable attorneys’ fees, resulting from:

• Your violation of these Terms or any applicable law
• Your violation of any third-party rights, including intellectual property rights
• Your misuse of our Services or Products
• Any academic misconduct or dishonesty involving our Products
• Any content or materials you provide to us
• Your negligence or willful misconduct
• Any claims by your educational institution arising from your use of our Services

You may terminate your account at any time by contacting our support team. Upon termination, you will lose access to your account and all associated data. Any active Orders will be processed according to existing agreements, and termination does not relieve you of payment obligations for completed or in-progress Orders.

We reserve the right to suspend or terminate your account immediately, without notice or liability, for any reason, including but not limited to:

• Breach of these Terms
• Fraudulent, abusive, or illegal activity
• Multiple chargeback requests
• Harassment of staff or Writers
• Abuse of refund or revision policies
• Creating multiple accounts to exploit promotions
• Providing false information
• Non-payment or payment disputes

Before initiating any formal dispute resolution process, you agree to contact us at support@smartacademicwriting.com to attempt to resolve the dispute informally. We will work in good faith to reach a mutually satisfactory resolution within 30 days.

If informal resolution fails, any dispute arising from or relating to these Terms or our Services shall be resolved through binding arbitration rather than in court, except that you may assert claims in small claims court if your claims qualify.

Arbitration will be conducted by a neutral arbitrator in accordance with the American Arbitration Association (AAA) Commercial Arbitration Rules. The arbitrator’s decision will be final and binding, and judgment on the award may be entered in any court having jurisdiction.

Each party shall bear their own attorneys’ fees and costs unless the arbitrator awards fees and costs to the prevailing party. We will pay all AAA filing, administration, and arbitrator fees for claims less than $10,000 unless the arbitrator determines your claim was frivolous.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.

To the extent that arbitration does not apply, you agree that any legal action or proceeding arising out of or related to these Terms or our Services shall be brought exclusively in the federal or state courts located in Delaware, and you consent to the personal jurisdiction of such courts.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

We reserve the right to modify, update, or replace any part of these Terms at any time at our sole discretion. We will provide notice of material changes by:

• Posting the updated Terms on our website
• Updating the “Last Modified” date at the top of this page
• Sending email notification to your registered email address for significant changes
• Displaying a prominent notice on our website

Your continued use of our Services after any such modifications constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must discontinue use of our Services.
